Terms of Use

1. Agreement

These Terms form a binding agreement between you and Yan Koshelev, the operator of UVC. Continued use after we post changes means you accept the revised Terms, unless applicable law requires otherwise.

Our Privacy Policy explains how we collect and use personal data. It is available at app.univehcup.com/privacy and is incorporated by reference for that purpose. These Terms govern your use of the service; the Privacy Policy governs personal data.

3. The service

UVC lets you run timed sessions on predefined paths (and, where available, paths you record). When you start a race, GPS records your line. After you finish, we compute results such as duration, distance, speed, and path deviation, and may show them on standings and share pages.

You pick a vehicle from your garage, start near the path when required, drive the course, and finish in the app. Only one active race per account is allowed at a time.

app.univehcup.com does not provide in-browser product sign-in. It serves store links, Universal Links / App Links fallbacks, public nickname profiles, and race share cards.

UVC is currently free. This version has no in-app purchases, subscriptions, or paid features. If paid features are added later, we will update these Terms and the store listing before charging.

4. Eligibility

UVC is not directed to children under 13. You must not use the service if you are under 13.

You may only race where you are legally allowed to drive and only with a vehicle and licence (if required) that comply with local law. You are solely responsible for confirming that your use of public roads for a timed GPS session is lawful where you are.

5. Accounts

Sign-in is provided by Clerk (email/password or Google / Apple). You must provide accurate account information and keep credentials secure. You are responsible for activity under your account.

In UVC you maintain a public nickname and optional profile settings. Other drivers see your nickname — not your Clerk email or real name — on leaderboards, share cards, and public profiles.

Do not create accounts to evade suspension, manipulate standings, or impersonate others.

6. Road safety and driver responsibility

UVC records GPS against a path for scoring. It does not give you permission to speed, ignore signs, or race other traffic. UVC is not a racing licence, closed-course event, or authorization to break traffic law.

You must obey speed limits and all applicable traffic and safety laws. If the road, weather, traffic, vehicle, or your condition is unsafe — do not start a race. You may abandon a session at any time to drive safely.

By using UVC you confirm that you will drive with care. Any ticket, crash, injury, death, or property damage arising from how you drive — or from choosing to race on public roads — is solely your responsibility, not UVC’s.

You assume all risk associated with operating a vehicle while using the app, including distraction from interacting with the device. Do not interact with the app in a way that reduces safe control of the vehicle.

7. Fair play

Results must reflect genuine driving on the path. We may void results or suspend accounts if we reasonably believe you violated this section. You must not:

• Spoof, fake, or manipulate GPS or telemetry
• Use automated tools, modified clients, or other means to submit false race data
• Abuse multi-accounting or share accounts to distort standings or challenges
• Interfere with other users or the integrity of the service

8. Vehicles and user content

You may store vehicle details and photos in your garage and may submit path recordings where the product allows. You retain rights in content you own, but you grant UVC a worldwide, non-exclusive, royalty-free licence to host, process, display, and distribute that content as needed to operate the service (including public nicknames, results, share cards, and path geometry derived from recordings you submit).

If you care about privacy, blur or cover license plates before uploading. Do not upload content you do not have rights to, or that is unlawful or abusive.

9. Results and rankings

Duration is the primary ranking score. Distance, speed, and path adherence may appear on results. Standings and challenges may unlock after your first finish.

GPS-derived times and speeds are not certified timing or speed measurements. Peak or average speed shown in the app is not an official or legal speed reading.

We may correct, void, or remove results if data appears incomplete, corrupted, abusive, or inconsistent with fair play. Challenging or share pages may update when results change.

10. Public visibility

Depending on features you use, other users and visitors of public web pages may see your nickname, race results, challenge or share cards, vehicle labels, and public profile information. They do not see your Clerk email or real name through UVC.

11. Intellectual property

UVC branding, the app, official path data, and related materials are owned by us or our licensors. You may not copy, scrape, resell, or redistribute path geometries, standings data, or the service except as allowed by these Terms or applicable law.

Subject to these Terms, we grant you a personal, non-transferable, revocable licence to use the app for its intended purpose.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Maps, GPS, cellular networks, and third-party services may be inaccurate, delayed, or unavailable. We do not warrant that results, proximity checks, or notifications will be error-free.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UVC AND ITS OPERATORS, AFFILIATES, AND SUPPLIERS ARE NOT LIABLE FOR ANY TICKETS, FINES, ACCIDENTS, INJURY, DEATH, PROPERTY DAMAGE, OR OTHER HARM ARISING FROM YOUR DRIVING OR YOUR USE OF PUBLIC ROADS IN CONNECTION WITH THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER THEORY.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

14. Indemnification

You agree to indemnify and hold harmless UVC and its operators, affiliates, and suppliers from claims, losses, and expenses (including reasonable legal fees) arising out of your driving, your violation of law or these Terms, or your user content — except to the extent caused by our wilful misconduct where such limitation is not allowed.

15. Termination

We may suspend or terminate access if you breach these Terms, abuse the service, or create risk to others or to the platform. You may stop using UVC at any time and may delete your account from Profile in the app. Deletion removes your authentication account and your UVC server data as described in the Privacy Policy.

16. Privacy

Personal data is handled as described in the Privacy Policy at app.univehcup.com/privacy. If there is a conflict about personal data processing, the Privacy Policy controls for that topic.

17. Changes

We may update these Terms from time to time. The “Last updated” date at the top will change when we do. Continued use of UVC after an update means you accept the revised Terms, unless applicable law requires otherwise.
